Hemp Derived CBD Vs. Hemp Derived Marijuana

Marijuana and hemp are two terms used to describe different types of cannabis, and both can produce CBD.

Although they are both from the same family and have visual similarities, their chemical composition is different. Mainly, the level of Tetrahydrocannabinol (THC) – the psychoactive compound responsible for the “high” sensation, is different for both.

While marijuana can produce up to 30% THC, the level of THC in hemp is almost non-existent (<0.3%)

As marijuana has higher levels of THC, it can produce mind-altering effects, and thus its use in the USA is illegal.

Legality of CBD in USA

But CBD produced from the hemp is legal when it is produced as per the guidelines defined by the laws.

According to the farm bill of 2018, the use of CBD is legal when:

  • The hemp contains > 0.3% THC
  • It is grown by a licensed grower
  • The hemp follows the state-federal regulations

Legality of Marijuana in USA

The legality of marijuana-derived CBD is a tad bit complicated as the use of marijuana is illegal. In some states, such as Colorado and California, marijuana can be legally used for recreational purposes and so is marijuana-derived CBD.

States, where Marijuana-derived cannabidiol is legal to use for recreational purpose, are:

  • Alaska
  • Colorado
  • Massachusetts
  • Nevada
  • Vermont
  • California
  • Maine
  • Michigan
  • Oregon
  • Washington

To date, 47 states allow the use of Marijuana-derived cannabidiol for medicinal use. However, the regulations differ from state to state.

Three states where Marijuana-Derived cannabidiol is illegal are:

  • Idaho
  • South Dakota
  • Nebraska

In either case, it is recommended to consult your doctor and check for the state guidelines before using CBD products.
