Cannabis laws differ for all states, and it is thus understandable to get confused regarding the legality of CBD sources.

Talking about New Hampshire, while it may not be the best state for CBD enthusiasts, you can still be able to get CBD products legally. Confused? Well, don’t be. We are breaking down the laws according to its sources and their legal status. So, let’s begin.

Legal Status of CBD Oil in New Hampshire

CBD oil comes from two primary sources, hemp, and marijuana. As the THC content, the chemical responsible for psychoactive properties of cannabis is different for both, their legal status is also different.

Marijuana-Derived CBD Oil

Now the legal status of cannabidiol oil from marijuana depends on the purpose of its use.

Recreational Use

While its neighboring countries, Massachusetts and Maine, have legalized marijuana, the laws of New Hampshire don’t allow the use of marijuana for recreational purposes.

As per the law:

  • For the first offense, possessing less than ¾th ounce of marijuana results in a fine of $100.
  • Subsequent possessions can result in a fine of up to $1200.
  • If you possess more than ¾th ounce of marijuana, you may have to pay a fine of $350 and punished with imprisonment for a year.

For concentrates, the law remains the same—just the quantity changes from ¾th ounce to 5 grams.

Medical Use

New Hampshire does allow you to use marijuana for medical purposes if you are diagnosed with either of the following conditions:

  • Alzheimer’s disease
  • Cachexia
  • Chronic pancreatitis
  • Ehlers-Danlos syndrome
  • Glaucoma
  • HIV/AIDS
  • Muscular dystrophy
  • Parkinson’s disease
  • Post-traumatic Stress Disorder
  • Severe nausea
  • Severe vomiting
  • Spinal cord disease or injury
  • ALS

  • Chronic pain
  • Crohn’s disease
  • Elevated intraocular pressure
  • Epilepsy
  • Hepatitis C
  • Lupus
